Rather than paying lawyers huge fees for a case he may not win, surely the sensible and most cost effective solution would be for Hilton to bite the bullet over the issues he’s raised and just pay Swann what they agreed initially? The elephant leaves the room and long term security of the club assured. It’s what we all want isn’t it? Surprised none of the blokes on the latest Iron Hour Podcast suggested this tbh.

People will say that the subsequent issues found by Hilton justify the refusal to commit to paying. However, if the court rules against Hilton, stating that Swann hasn’t moved goalposts significantly and there are any comments which make such found issues seem small, I won’t be thanking Hilton for ‘trying his best’. I will be blaming him for his part in what would be a bad outcome for the club, alongside Swann.

Then, it would obviously be a good thing. I don’t see how squatting and paying for a rent deal that Swann doesn’t want is a viable position, legally, but I am no expert by any means.

Has Hilton really refused to pay, surely the judge could have ruled straight away if that was the case.

Pretty sure Hiltons defence is a little more complex than that.

I think it will boil down to it being a community asset, Swann has reneged on stuff on the deal and/or there are other issues etc. As I initially said, hence why I said if he is found to lose. I don’t pretend to know the outcome.

We have a Barrister or 2 on the Board now. Would I ever believe Mr Swann – NO. If someone with a legal eye has seen something that is concerning then that needs resolving. So until it is resolved we sit and wait.

It was suggested that the community asset caveat wouldn’t come into play unless Swann tried to sell to a third party who would use the land for other means .

Hilton confirmed to us that he has never paid Swann £20k a month in rent. He publicly offered £10k a month in an interview with
@aidanmccartney
and said it was likely double the market value but that’s as far as it got. Initial lease from Swann to DH was 1p a day. Sublease from DH to SUFC mirrors this, hence the 7p a week figure.

I took time to corroborate a rumour I heard and kept hitting a wall, a solicitor friend searched a site and found it for me. For confirmation I also joined the site. It’s a bizarre accusation to suggest that somebody created a whole site listing every court case in the country daily in order to do this one thread. There’s not enough time in the world for me to mess about that much, and I certainly don’t have the skills

I don’t necessarily prescribe to the animosity but I totally understand it having seen the dog whistling and the problems it caused. Too much old ground to go over here but suffice to say some humble pie and acknowledgement of past mistakes wouldn’t do him any harm.
